VOLUNTARY WAIVER AND RELEASE FROM LIABILITY AGREEMENT AND HOLD HARMLESS AND INDEMNIFICATION AGREEMENT

I desire for my child participating in the Scott Hemond School of Baseball, LLC Camp (hereinafter referred to as the camp@). In consideration for my child participating in the Camp I acknowledge and agree on behalf of myself, my family, and my child.

1. Risks

I understand that my child participating in the Camp may involve risks of injury to my child or to other persons or property. Such risks include, but are not limited to, serious injury, paralysis, dismemberment, permanent disability, and death, and other losses to my child, myself and my family.

I understand that these injuries and losses can result not only from Scott Hemond=s actions, inactions or negligence, but the actions, inactions or negligence of the adults and/or children participants, and other individuals assisting or participating. I also understand that injuries and losses can result from the condition of the facilities and the equipment used. Additionally, I understand that injuries and losses can result from the participants whether they be children, employees, volunteers, or any other individuals not being in the proper physical condition to participate.

I specifically recognize that my child participating in the Camp includes the risk of my child being injured and others being injured.

2. Assumption of the Risk

I assume all risks in any way connected with associating or participating in the Camp. I accept responsibility for any injury or loss in any way connected with my child=s participation in the Camp. I assume all responsibility for my child being in the proper physical condition to participate in the Camp.

3. Waiver and Release

I waive, release, hold harmless, and promise not to file a lawsuit or make any claim against Scott Hemond or his associates for any injury, disability, death and/or loss or damage in any way connected with my child participating in the Camp, whether or not caused in whole or part by the actions, inactions or negligence of Scott Hemond or his associates.

4. Hold Harmless Indemnify

I hereby indemnify Scott Hemond and his associates and agree to undertake to defend Scott Hemond from and against all claims, suits, losses and damages arising out of or in any way connected with my child participating in the Camp. I agree to indemnify and hold harmless Scott Hemond from any and all liability, loss, or damage that my child may suffer as a result of claims, demands, costs including attorney fees, or judgments or other actions against Scott Hemond arising out of or in connection with my child participating in the Camp

5. Applicable Law

This Voluntary Waiver and Release From Liability Agreement and Hold Harmless and Indemnity Agreement is to be interpreted consistent with the laws of the State of Florida. If any portion of this Agreement is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall be deemed severable and enforced to the maximum extent consistent with the law.

I have read this voluntary waiver and release from liability agreement and hold harmless and indemnity agreement. I understand that myself, my child and my family have given up substantial rights by my electronically signing this document on behalf of my child, myself, and my family.

Medical Consent

I hereby give consent and permission to Scott Hemond and his designated representatives, to call 911, or take my child named below to any licensed hospital or emergency medical facility and to admit my child for treatment for any cause whatsoever, when under the supervision of Scott Hemond and/or his designated representatives. I will be responsible for the charges for these actions on behalf of my child and agree to hold Scott Hemond and his designated representatives harmless for any liability therefore.

In consideration of me or my child being permitted to participate in lessons and/or camps conducted by Scott Hemond and his designated representatives, the undersigned for him/herself and the minor releases, waives, discharges and covenants not to sue Scott Hemond or his designated representatives from all liability to or claim for damages against me or my child on account of injury to the person or property, whether caused by the negligence or otherwise while traveling to or from or participating in any lesson and/or camps, for which this application is made. This release contains the entire agreement between the parties to this agreement and the terms of this release are contractual and not a mere recital.
